These Terms & Conditions (“Terms”) govern the access to and use of https://www.theaganze.com (“Website”) and the purchase of products from Aganze, (SIMMARA ENTERPRISES LLP).
By accessing, browsing, or making a purchase on the Website, you agree to be legally bound by these Terms, our Privacy Policy, Cookie Policy, and other policies displayed on the Website.
If you do not agree, please do not use the Website.
1. DEFINITIONS & INTERPRETATION
- “Customer” / “User” means any person accessing or purchasing from the Website.
- “Product” means jewellery items offered for sale on the Website.
- “Order” means a request placed by the Customer to purchase Products.
- “Platform” means the Website and related digital interfaces.
Headings are for convenience only and shall not affect interpretation.
2. ELIGIBILITY
- You must be 18 years or older to use this Website and place orders.
- By placing an order, you confirm that you are legally capable of entering into a binding contract under Indian law.
3. PRODUCT INFORMATION & REPRESENTATION
3.1 Images & Descriptions
- Product images are for illustrative purposes only.
- Jewellery is handcrafted and may show minor variations in design, finish, texture, or colour.
3.2 Weight & Stone Variations
- Gold, silver, gemstone, and diamond jewellery may have minor weight variations due to manufacturing processes.
- Natural gemstones may vary in colour, clarity, and inclusions, which are inherent characteristics and not defects.
4. PRICING & TAXES
- All prices are listed in Indian Rupees (INR) unless stated otherwise.
- Prices may include or exclude applicable taxes, which will be shown at checkout.
- We reserve the right to correct pricing errors at any time, even after an order is placed.
5. ORDERS & ACCEPTANCE
- Placing an order constitutes an offer to purchase.
- Orders are confirmed only after successful payment and order confirmation email.
- We reserve the right to cancel orders due to:
- Pricing or inventory errors
- Fraud suspicion
- Incomplete or inaccurate information
In such cases, a full refund will be initiated.
6. PAYMENTS
- Payments are processed securely via Razorpay Software Private Limited.
- We do not store card, UPI, or banking details.
- Payment failures, delays, or technical issues attributable to Razorpay or banks are outside our control.
- Cash on Delivery (COD) is available on select orders and locations. COD charges, if applicable, will be displayed at checkout. COD refunds are processed via bank transfer only.
7. SHIPPING & DELIVERY
- Products are shipped via Delhivery Limited or authorized logistics partners.
- Delivery timelines are estimates only and may vary due to location, weather, operational delays, or force majeure events.
- Risk of loss passes to the Customer upon successful delivery.
8. RETURNS, REFUNDS & EXCHANGES
Returns, refunds, and exchanges are governed by our Return & Refund Policy, including:
- 7-day return window from delivery
- Jewellery must be unused, undamaged, with tags and original packaging
- Return shipping is covered by Aganze for eligible returns
- Certain items (customised jewellery, earrings, toe rings, clearance items) are non-returnable
9. CANCELLATIONS
- Orders may be cancelled prior to dispatch.
- Once shipped, cancellation requests are subject to return eligibility and inspection.
10. USER OBLIGATIONS
You agree:
- To provide accurate and complete information
- Not to misuse the Website or its content
- Not to engage in fraudulent, abusive, or unlawful activity
11. INTELLECTUAL PROPERTY
- All content, designs, images, logos, trademarks, and product designs are the exclusive intellectual property of Aganze.
- Any unauthorised copying, reproduction, resale, or commercial use is strictly prohibited.
12. DISCLAIMER
- Products are sold “as is” subject to statutory warranties.
- Natural variations in handcrafted jewellery do not constitute defects.
13. LIMITATION OF LIABILITY
To the maximum extent permitted by law:
- We shall not be liable for indirect, incidental, or consequential damages.
- Our total liability shall not exceed the value of the Product purchased.
14. INDEMNITY
You agree to indemnify and hold harmless Aganze from claims arising out of:
- Violation of these Terms
- Misuse of the Website
- Breach of applicable laws
15. FORCE MAJEURE
We shall not be liable for failure or delay due to events beyond reasonable control, including natural disasters, strikes, government actions, or logistics disruptions.
16. GOVERNING LAW & JURISDICTION
These Terms shall be governed by the laws of India. shall have exclusive jurisdiction.
17. AMENDMENTS
We reserve the right to modify these Terms at any time. Continued use of the Website constitutes acceptance of revised Terms.
